TERMS AND CONDITIONS FOR LOADIN USERS

SECTION 1: GENERAL TERMS
1. Introduction
These Terms and Conditions (“Terms”) govern your use of LoadIn’s services, including the mobile app, website, and related technology (collectively, the “Platform”). By accessing or using the Platform, you agree to comply with these Terms. If you do not agree, you may not use LoadIn’s services.
2. Definitions
• “Driver” refers to individuals or entities using LoadIn to offer delivery or transportation services.
• “Client” refers to individuals or businesses requesting transportation or delivery services via the Platform.
• “Goods” refer to items being transported.
• “LoadIn” refers to the company owning and operating the Platform.
3. Eligibility
• Users must be at least 18 years old.
• Drivers must possess valid identification, vehicle documentation, and relevant permits.
• Clients must provide accurate contact and delivery details.
4. Modification of Terms
LoadIn reserves the right to update these Terms periodically. Continued use of the Platform constitutes acceptance of the revised Terms.
SECTION 2: DRIVER TERMS
1. Driver Obligations
• Maintain valid licenses, permits, and vehicle insurance.
• Ensure the vehicle is roadworthy, clean, and suitable for the services offered.
• Comply with traffic laws, safety standards, and LoadIn policies.
2. Earnings and Payments
• Earnings are calculated based on distance, time, and applicable fees.
• LoadIn deducts a commission percentage from each completed trip.
3. Indemnity Clause
Drivers agree to indemnify and hold harmless LoadIn, its affiliates, and employees against any claims, damages, or legal actions arising from:
• Negligence during transportation.
• Breach of traffic laws or regulations.
• Loss or damage to goods.
4. Insurance Requirements
• Drivers must provide proof of valid comprehensive vehicle insurance.
• Additional goods-in-transit insurance may be required for specific categories of shipments.
5. Suspension and Termination
• LoadIn reserves the right to suspend or terminate a driver’s account for violations, including fraudulent activities, unsafe driving, or misconduct.
• Drivers may terminate their use of the Platform by providing written notice, subject to the settlement of outstanding obligations.
SECTION 3: CLIENT TERMS
1. Client Obligations
• Provide accurate information about pick-up and delivery locations, and the nature of goods.
• Ensure goods are appropriately packaged and labeled.
2. Prohibited Goods
Clients must not transport hazardous materials, illegal items, or goods restricted under applicable laws. Violations will result in immediate account suspension and may involve reporting to authorities.
3. Pricing and Payments
• Clients will see an estimated cost before confirming a booking.
• Payments are processed through the Platform using approved payment methods.
4. Cancellations and Refunds
• Clients may cancel a booking within a specified timeframe.
• Refunds are subject to cancellation policies outlined in the app.
5. Insurance for Goods
• Clients are encouraged to purchase goods-in-transit insurance via LoadIn or a third party for high-value shipments.
• LoadIn offers optional insurance coverage at an additional cost for eligible shipments.
6. Refunds for Lost or Damaged Goods
• LoadIn’s liability for lost or damaged goods is limited to the value declared by the client at the time of booking, provided sufficient evidence is submitted (e.g., invoices, receipts).
• Claims must be submitted within 7 days of the delivery date.
• LoadIn may deny claims for improper packaging, prohibited goods, or non-compliance with Platform policies.
7. Indemnity Clause
Clients agree to indemnify LoadIn, its affiliates, and employees against any claims or damages arising from:
• Misrepresentation of goods.
• Non-compliance with packaging or labeling requirements.
• Losses resulting from delays caused by inaccurate information.
SECTION 4: LIABILITY AND DISCLAIMERS
1. Platform Usage
• LoadIn provides a marketplace connecting drivers and clients but does not directly handle transportation or goods.
• Drivers are independent contractors, not employees of LoadIn.
2. Limitations of Liability
• LoadIn is not liable for losses due to delays, accidents, or unforeseen circumstances unless otherwise covered by insurance purchased via LoadIn.
• LoadIn’s total liability for a claim will not exceed the value declared for the shipment.
3. Force Majeure
LoadIn is not responsible for service disruptions caused by events beyond its control, such as natural disasters, strikes, or government actions.
SECTION 5: DATA PRIVACY
1. Data Collection
LoadIn collects user data for operational and security purposes.
2. Data Sharing
User data will not be shared with third parties without consent, except as required by law.
3. Security
LoadIn implements industry-standard measures to protect user data but cannot guarantee absolute security.
SECTION 6: DISPUTE RESOLUTION
1. Reporting Issues
Clients and drivers must report disputes through the Platform’s support system.
2. Arbitration
Disputes unresolved through mediation will be referred to arbitration under applicable Nigerian laws.
SECTION 7: TERMINATION AND SUSPENSION
1. LoadIn’s Rights
LoadIn reserves the right to terminate any account for violations of these Terms.
2. User-Initiated Termination
Users may deactivate their accounts by notifying LoadIn, subject to outstanding obligations.
SECTION 8: ADDITIONAL PROVISIONS
1. Non-Exclusivity
Drivers and clients may use other platforms; however, using LoadIn’s resources for external transactions is prohibited.
2. Insurance Compliance
Users must comply with insurance requirements to ensure accountability and protection during operations.
3. Severability
If any provision of these Terms is deemed unenforceable, the remaining terms shall remain valid.
4. Indemnity Summary
Both drivers and clients agree to indemnify LoadIn against any liabilities arising from their actions, negligence, or breaches of these Terms.
